Monday August 7, 2017 at 11:59PM is the cutoff date for Giveaway entries. The total headlamps is now  5.

 

This notice of entry limitations and terms replaces any prior notices of terms and conditions.

 

Only one entry per individual, email address, or IP address is permitted.  

 

NO PURCHASE IS NECESSARY TO ENTER OR WIN.  A PURCHASE DOES NOT INCREASE THE CHANCES OF WINNING.

1. Eligibility: The  "Giveaway" Promotion is open only to those who sign up at the online sweepstakes page and who are 18 years old or older as of the date of entry. The Giveaway is only open to legal residents of the  50 United States, the District of Columbia, and Canada (excluding the province of Quebec) and is void anywhere prohibited by law. The Giveaway is subject to all applicable federal, state and local laws and regulations.  Winners at the time of the drawing may not be direct affiliates of Nulumina Corporation or its employees. 

2. Agreement to Rules: By participating, you agree to be fully unconditionally bound by these Rules, and you represent and warrant that you meet the eligibility requirements set forth herein. In addition, you agree to accept the decisions of Nulumina Corporation, as final and binding as it relates to the content. The Giveaway is subject to all applicable federal, state and local laws.

3. Giveaway Promotion Period: Entries will be accepted online starting on or about July 8, 2017. All online entries must be received by August 7, 2017 at 11:59 PM PST.  Prior email notification list signups from June and July 2017 will be automatically entered. 

4. How to Enter: The Giveaway must be entered by submitting an entry by subscribing to our "NightOwls" email notification list at www.nulumina.com, or by linking to the Entry form via Nulumina on Facebook, @nulumina  on twitter, or via any other authorized links that may be added by Nulumina Corporation during the Giveaway promotion period.  The entry must fulfill all promotion requirements, as specified, to be eligible to win a prize. Entries that are not complete or do not adhere to the rules or specifications may be disqualified at the sole discretion of Nulumina Corporation. You must fill in the information requested. You may not enter more than one time by using multiple email addresses, identities or devices in an attempt to circumvent the rules. Only one IP address may be used per entry. Multiple emails or parties may not enter the Giveaway using the same IP address.  If you use fraudulent methods or otherwise attempt to circumvent the rules your submission may be removed from eligibility at the sole discretion of Nulumina Corporation. However, you are eligible to participate in any other contests, sweepstakes,  giveaways, or other promotions that Nulumina may offer during the duration of this Giveaway, or thereafter. 

 

Only proper electronic entries through the Nulumina Website or our linked URL sign up for notification form and this Giveaway will be considered valid.  No paper, message, spoken, or other type mail entries will be accepted as valid. 

5. Prizes: Five (5) Winners will be randomly selected. Each winner will win one CYRAD Owlsight headlamp.  Each winner will be shipped one OwlSight Headlamp (Manufacturers Suggested Retail Price to be found on our website at a future date after Crowdfunding Launch). Actual/appraised value may vary between from listed price posting and may vary before prize award shipment due to special offers, sales, and other changes affecting potential value.  The specifics of the prize shall be solely determined by the Sponsor. No cash or other prize substitution is permitted except at Sponsor's discretion. The prize is nontransferable.  Any and all prize related expenses, including without limitation any and all federal, state, and/or local taxes shall be the sole responsibility of the winner. Canadian winners will be responsible for shipping costs above that of average USA USPS priority medium-box shipping costs, along with any fees or duties associated with shipment to Canada. No substitution of a prize or transfer/assignment of a prize to others or request for the cash equivalent by winners is permitted. Acceptance of prize constitutes permission for Nulumina Corporation to use winner's name, likeness, and entry for purposes of advertising and trade without further compensation, unless prohibited by law.
 

6. Odds: The odds of winning depend on the number of eligible entries received.

7. Winner selection and notification: Winners of the Giveaway will be selected in a random selection from entrants by Nulumina Corporation. Winners will be notified via email to the email address they entered the Giveaway within two (2) days following the winner selection. Nulumina Corporation shall have no liability for a winner's failure to receive notices due to winners' spam, junk e-mail or other security settings or for winners' provision of incorrect or otherwise non-functioning contact information. If the selected winner cannot be contacted, is ineligible, fails to claim the prize within 10 business days from the time award notification was sent, or fails to timely return a completed and executed declaration and releases as required, your prize may be forfeited and an alternate winner may be selected.

The receipt by winner of the prize offered in this Giveaway is conditioned upon compliance with any and all federal and state laws and regulations. ANY VIOLATION OF THESE OFFICIAL RULES BY ANY WINNER (AT SPONSOR'S SOLE DISCRETION) WILL RESULT IN SUCH WINNER'S DISQUALIFICATION AS WINNER OF THE SWEEPSTAKES AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED.

8. Rights Granted by you: By entering this promotion, you understand that Nulumina Corporation, anyone acting on behalf of Nulumina Corporation, or its respective licensees, successors and assigns will have the right, where permitted by law, without any further notice, review or consent to print, publish, broadcast, distribute, and use, worldwide in any media now known or hereafter in perpetuity and throughout the World, your entry, including, without limitation, the entry and winner's first name, initial of last name, city, state or province, or statements about the Sweepstakes, as news, publicity or information and for trade, advertising, public relations and promotional purposes without any further compensation. We will not publish or disclose your last name, email address, shipping address, or other personal information without your permission. unless required by law. 

9. Terms: Nulumina Corporation reserves the right, in its sole discretion to cancel, terminate, modify or suspend the Giveaway should (in its sole discretion) a virus, bugs, non-authorized human intervention, fraud or other causes beyond its control corrupt or affect the administration, security, fairness or proper conduct of the Giveaway. In such case, Nulumina Corporation may select the recipients from all eligible entries received prior to and/or after (if appropriate) the action taken by Nulumina Corporation. Nulumina Corporation reserves the right at its sole discretion to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Giveaway promotion or Sponsor's website or violates these Terms & Conditions.

Nulumina Corporation has the right, in its sole discretion, to maintain the integrity of the Giveaway, to void votes for any reason, including, but not limited to; multiple entries from the same user from different IP addresses; multiple entries from the same computer in excess of that allowed by sweepstakes rules; or the use of bots, macros or scripts or other technical means for entering.
 

Any attempt by an entrant to deliberately damage any web site or undermine the legitimate operation of the Giveaway may be a violation of criminal and civil laws and should such an attempt be made, Nulumina Corporation reserves the right to seek damages from any such person to the fullest extent permitted by law.

10. Limitation of Liability: By entering this Giveaway promotion, you agree to release and hold harmless Nulumina Corporation and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers and directors from any liability, illness, injury, death, loss, litigation, claim or damage that may occur, directly or indirectly, whether caused by negligence or not, from (i) such entrant's participation in the Giveaway and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof, (ii) technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware or software; (iii) the unavailability or inaccessibility of any transmissions or telephone or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Promotion; (v) electronic or human error which may occur in the administration of the Promotion or the processing of entries. Furthermore, in the near future, Nulumina will be commencing Crowdfunding activities to support the production assembly of the CYRAD system via Kickstarter. 11. Disputes: THIS GIVEAWAY PROMOTION IS GOVERNED BY THE LAWS OF USA AND WA STATE, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this Giveaway, participant agrees that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or connected with this Giveaway, shall be resolved individually, without resort to any form of class action, exclusively before a court located in WA having jurisdiction. Further, in any such dispute, under no circumstances will participant be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental, or consequential damages, including reasonable attorneys' fees, other than participant's actual out-of-pocket expenses (i.e. costs associated with entering this Giveaway), and participant further waives all rights to have damages multiplied or increased.

12. Privacy Policy:  Information submitted with an entry will become the property of Nulumina. Nulumina cannot guarantee data privacy, but will take reasonable security precautions. 

 Your email address will not intentionally be made public by Nulumina unless required by law. Your first name, first initial of your last name, city, and state or province will be listed on our website as a winner unless you provide written permission to use your full name. or other information.  However,  your full name and address information will be required within 30 days of the drawing, or the prize may be forfeited. This information is also necessary for shipment. Shipping information must be updated with Nulumina if you change the shipping address before the prize shipping date. We will need to re-verify your name and shipping address prior to the October shipping date. Some carriers also seek a phone contact number for a package recipient.  We will let you know by email if a phone number is necessary before an insured shipment would be made.

13. Winners List: To obtain a copy of the winner's name or a copy of these Official Rules, mail your request along with a stamped, self-addressed envelope to Nulumina Corporation PO Box 50385,  Bellevue WA 98015 USA. Requests must be received no later than September 30, 2017. The list of first names of winners and their states or provinces will also be provided on the www.nulumina.com website, based on the names provided by the winners.
